摘要
新世纪以来,我国学者对国际金融法领域新遇到的欧元法律问题、证券间接持有跨境法律问题、资产证券化法律问题、国际融资浮动担保法律问题、网络银行相关法律问题进行了研究。在研究中导入了法律社会学和法哲学等多种研究方法,并运用成熟的理论来研究国际金融法问题,为国际金融法学的研究提供了新的视角,但是也存在过于侧重具体制度和具体问题的研究,基础理论体系尚待进一步建立和完善、实务性偏强,法律性尚待突出、研究主题过于集中,存在若干研究死角等不足。
The Researches of Chinese scholars focus on the new legal matters regarding Euro dollar, transnational holding of the securities, securitization, floating charge and network banking etc. The research methods of legal sociology and legal philosophy, as well as the classical theories have been used in the study of international financial law. It gives us a new perspective for research of international financial law. But the problems are that the research topics emphasize particularly on the specific system and issues rather than the basic theory. The scholars focus more on the practice rather than the legal matters. The subjects of study coincide too much in certain fields while other important issued have not been concerned.
