摘要
不论动产、不动产均存在无权处分,因此,为保护第三人利益,维护交易安全,不动产也应如动产一样,以善意取得制度予以调整。在一个不动产上设立数个抵押权,立法上应予肯认而非拒绝,其解决权利冲突的办法是确立抵押权的实现位次。我国《合同法》第二百八十六条确立的是法定抵押权,法定抵押权之标的仅限于工程本身不够,还应及于工程所用之土地使用权,法定抵押权之成立应以登记为条件。
Whether movable property or immovable property, there exist the problem of no right to dispose them. So in order to protect the benefit of third party and defend exchange safety, immovable property as well as movable property must be adjusted by good faith acquisition systeml Setting up several mortgages on one immovable property ought to be agreed but not refused in the legislation. The method of resolving right conflicts is to establish the seating arrangement. Article 286 of Contract law of our country regulates the legal mortgage. It is not enough to limit the subject matter of legal mortgage to the engineering itself, but includes right to use land for engineering. The establishment of legal mortgage should take registration as the condition. Legal mortgage has unconditional priority to contractual mortgage, but it should limit to the salary of laborer and labor pay.
