摘要
修正后的《婚姻法》首次在婚姻家庭领域中正式确立离婚损害赔偿制度,它填补了我国在离婚过错责任方面的立法空白,进一步保护了婚姻当事人的合法权益。但由于此项制度只是原则性的规定,在具体司法实践中缺乏操作性,本文从离婚损害赔偿制度的性质、构成要件、司法实践中存在的问题及对策等方面进行探讨,以期提高离婚损害赔偿制度的操作性。
The revised （Marriage Law）first established the Divorce Harm Compensatoty System in the realm of families, it filed the legislative blank of divorce fault responsibility in China thus further protecting the legitimate rishts and interests of both parties concemed. But because the system is just a new stipulation of principle, it lacks operability in concrete judicial pracrice. So the article aims to discuss the character,key components,main problems in judicial practice and counter measures in order to improve the operability of the Divorce Harm Compensatory System.
