后TRIPs时代知识产权制度的变革与中国的应对方略被引量：42

摘要进入21世纪后,高新技术的发展日新月异,对传统的知识产权制度产生了空前的冲击。当前,随着经济全球化进程的加快和法律趋同化趋势的日益明显,知识产权制度的变革与发展也日益呈现出一体化、国际化的趋势。而在这一体化、国际化大趋势的背后,知识产权制度变革与发展中的许多重大问题,如知识产权制度的现代化、知识产权与其他人权的冲突及其协调、后TRIPs时代中国的应对方略,等等,已摆在我们面前。如何解答这些问题,是我国知识产权法学界当前乃至今后一段时期内的重大课题。为对上述问题有一个清晰、明了的认识,本刊约请五位学者进行研讨,以期引起法学界的重视和关注。
