摘要
法治秩序在乡村的建立是依法治国的必然要求,但是乡村社区的风俗、情理等民间法的普遍存在是转型期乡村社会的客观现实,因此,乡村社会法治秩序的建构,无法撇开民间法来谈论乡村的法治建设。
It is demanded by the principle of running the country by law to set up the order ruled by law in the countryside. However, it is impossible to discuss the legal construction in the rural areas without considering the objective fact that the customary law of the custom, sensibility and rationalization in the rural communities exists commonly in the period of the transformation. So, the construction of the order ruled by law in the countryside cannot leave the customary law aside.
