摘要
从环境公平、环境正义的深层含义和环境生态功能的效益最大化着手,结合我国森林生态保护的现实,分析了建立森林生态效益补偿制度的必要性,其次从我国目前的森林生态保护法律法规的相关规定和现行的森林生态效益补助办法实施的成功经验角度,论证了建立我国森林生态效益补偿制度的可能性。在此基础上,对建立森林生态效益补偿制度当前需要解决的补助与补偿观念、资金来源、补偿范围、相关主体的法律责任等问题进行了探讨和分析,并就这些问题的解决提出了相应的建议。
Based on the analysis on the deep meanings of environmental fairness and environmental justice and the economic analysis on ecological functions of environment and combined with the analysis on the status quo of the ecological protection of forests in China, this paper analyzes the necessity of establishing the compensation system for forest ecological benefits in China and then demonstrates the possibility of establishing the compensation system for forest ecological benefits in China from the perspective of the related present laws and regulations on ecological protection for forests and the successful experience in the implementation of current compensation system for ecological benefits of forests. On this basis, this paper discusses and analyzes the existing problems in the subsidy and compensation conceptions, source of capitals, extent of compensation, legal responsibilities of related main bodies in the process of establishing the compensation system for forest ecological benefits in China, and puts forward corresponding suggestions to these problems.
