摘要
农产品品牌是农业产品进入国内市场的"流通名片",参与国际贸易的"经济护照"。我国入世以来,以农产品商标和地理标志为主要内容的农产品品牌,正为农业转型增效、增加农民收入、保障农产品质量安全、提高市场竞争力方面发挥着巨大作用,业已成为国家及地方农业、商标行政管理部门,特别是理论界研究探索的热点问题。然而,由于部分历史和现实原因,农产品品牌及其相关权益法律层面的保护和救济仍存在诸多应完善的方面,亟需按照科学发展的要求,尽快构建一整套农产品品牌法律保障体系,确保农产品品牌权利义务主体依法进行品牌的占有、使用和保护,为我国农产品品牌发展保驾护航。
Agricultural products brand is the 'business card' of entering the domestic market and the 'economic passports' to participate in international trade.Since China's accession to the World Trade Organization in 2001 the agricultural products brand including agricultural products trademarks and agricultural products geographical indications,is increasingly playing a significant role in transformation of agricultural efficiency,increasing farmers' income,ensuring quality and safety of agricultural products,improving market competitiveness.Meantime,as part of the historical and practical reasons,there are still many aspects to be improved in the agricultural products brand and legal aspects related to the protection of rights and remedies.In accordance with the requirements of scientific development it is necessary to build a set of legal protection of agricultural products brand system as soon as possible to ensure the rights and obligations of the main agricultural products according to the brand possession,use and protection to escort the development of China's agricultural brand.
