摘要
出租人未通知承租人直接将租赁房屋出卖于第三人而承租人事后知悉向法院起诉的,法院除了宣告出租人与第三人之间的租赁房屋买卖合同无效之外,能否应承租人的请求而认定承租人与出租人之间以同等条件成立租赁房屋买卖合同?在优先购买权诉讼中,承租人的请求次数、优先购买权的期限限制、举证责任的承担、诉讼担保的提供、买卖合同的强制执行等等事宜也都需要明确。文章从实体与程序两个方面对于房屋承租人优先购买权的司法保护问题进行了研究。
When the lessor sells the house to a third party without telling the lessee and the lessee suits to court after knowing,the court should annul the contract.But can the court establish house sale contract between the lessor and lessee according to the lessee's request under the same condition? In the suit of preemptive right,these matters should be clear such as the number of the lessee's request,period limits of preemptive right,bearing the burden of proof,providing security in litigation,sale contract enforcement.The authors have studied the judicial protection problems of preemptive right of the lessee from the two aspects of entity and procedure.
