摘要
近年来施工企业合同纠纷案件呈现出高发态势,发包方动辄利用合同中的一些违约条款来获取利益.由于施工企业合同管理意识不强、合同管理工作不到位,致使其在合同纠纷案件应诉过程中屡屡败诉,造成了很大的经济损失.因此,施工企业必须加强施工合同管理,有效防范施工合同风险.本文主要在对施工合同风险进行分析的基础上,提出了防范施工合同风险的对策.
Contract disputes in recent years,construction companies showing high momentum,the party awarding the contract frequently use some default provisions to obtain benefits.As the construction is not strong sense of enterprise contract management,contract management in place,resulting in the process of responding to contract disputes often lost,resulting in great economic losses.Therefore,the construction enterprises must strengthen the construction contract management,effectively preventing the construction contract risks.This article focuses on the construction contract on the basis of risk analysis,proposed measures to prevent the risk of construction contracts.
