摘要
探讨严格责任内涵的演变及其存在合理性这两个基本问题,并对影响我国现阶段引入严格责任的因素做初步的分析:从宏观层面,由于两大法系司法理念以及犯罪圈划定的不同;从微观层面,由于举证责任倒置对被告人负担的加重,重刑主义传统所引发的对犯罪人的负面评价、我国违宪审查制度的缺乏以及司法工作人员素质有待提高等原因,我国现阶段还不宜大规模引入严格责任。
