摘要
近年来,在我国建筑业蓬勃发展的同时,建筑工程事故也频繁发生。为此,我国法律对建筑工程事故进行了相应的规范。但在明确建筑工程事故法律责任的过程中,却存在着对建筑工程事故法律责任如何承担的问题。本文在分析建筑工程事故法律责任承担概念的基础上,对建筑工程事故法律责任承担的主体、原则、责任形式及免责条款的适用范围进行了分析论证。
In recent years, while our country's construction industry grows vigorously, the construction work accidents frequently happen too. The construction work accidents have been standardized in the law of our country. To make clear the legal liability of construction work accidents, the problem of how to bear the legal liability of the construction work accidents exists. This text, based on the concept of legal liability of the construction work accidents, analyses the subjects, principles, responsibility form and scope of application of disclaimer of construction work accidents.
