摘要
案例教学法注重归纳推理,是美国等发达国家进行法律教学、培养优秀法律人才、并已为实践证明的一种有效手段。我国处于成文法法律体系中,倾向于以讲授为主的教学法,重在演绎推理。在我国的法律教学中,如何突破传统的教学模式,引进案例教学,通过案例教学的研究与实践,探索构建“以讲述为主、案例教学为辅”法律教学新模式,给法学理论与司法实践有机结合寻找一个连接点,成为我校法律系诸位教师的共识,并进行了理论研究和实践探索。笔者试图对之进行探索和总结,以期抛砖引玉。
Case teaching methodology, which pays attention to summing up reasoning, has been proved a kind of effective means to carry on law teaching and to train outstanding law talents in developed countries, such as U.S.A. Our country is in the legal system of the written laws, and is inclined to take the teaching method focusing on demonstrating reasoning. How to break through the traditional teaching mode in law teaching﹖ The teachers of our country have the common understanding, that is, to introduce case teaching. Through the research and practice of teaching through case we explore the new mode of law teaching of ″ relying mainly on telling and making case teaching subsidiary ″, and look for a connection order to combine law science theory and justice practice . We have carried on theoretical research and practical exploration. I attempt to explore and summarize it in the hope of casting a brick to attract jade.
