摘要
研究目的:考察澳大利亚昆士兰州托仑斯土地登记制度的历史、现状及其未来发展方向。研究方法:实地考察。研究结果:昆士兰州法律中“土地”即“不动产”;昆士兰州土地登记历史经历了3个阶段;自1861年引进托伦斯登记制度以来,已发展成特点鲜明、制度完备的“自动化权利系统(ATS)”;未来发展方向是废弃纸质文档,全面实现数字化。研究结论:托伦斯土地登记制度博大精深,内涵丰富细致、可操作性强、自动化程度高、稳定高效、经济贡献大等等,对中国建立完善的不动产登记制度有借鉴意义。
The purpose of this paper is to explore broadly the history,present and fu ture of the Queensland Torrens Titling system.Method of fi eld investigation was applied.The r esults show the wordlandin the Queensland' s law meansreal property.Queensland land registration has e xperienced three phases.Since the introduction of Torrens Registration system in 1861,the system has developed as a self -contained automatic title system(ATS)with distinguished characteristic s.The tendency is to abandon the paper documents and then realize full digitalization.It is c oncluded that the Torrens Land regis tration system owns the characteris tics of plenty and profundity,abundance an d detailed connotation,powerful im plementation ability,high automation,stability and high efficiency,and g reat contribution to socio -economi c benefit,etc.,which are extremely helpful and valuable for reference to establ ish perfect real property registration system in China.
