摘要
可持续发展理念因人类与环境关系的逐渐恶化而产生,可持续发展战略的实施熏将给人类社会带来巨大的变化,也会引起一场法律变革。今后,所有的立法均应把“保障可持续发展”作为立法的宗旨和指导思想,同时要按可持续发展的要求对现行法律法规进行重新评价和修改,将生态保护要求和可持续发展的思想融入各个法律部门之中。作为以现代经济核心——金融为调整对象的金融法律制度也要向着与环境保护相协调的方向转化,全面贯彻可持续发展的思想,即要使可持续发展的要求充分渗透于金融秩序、金融效率、金融公平等金融法的基本价值观之中。
The notion of the sustainable development was created due to the increasingly deteriorating relation between human beings and environment. The execution of the sustainable development strategy will bring a great social change and a legal reformation. The notion will be the aim and guiding thought of the future legislation, and the current rules and laws will be reappraised and revised for the environment preservation and sustainable development in all law branches. The legal system of finance, with the finance and the modern economic core as its adjustment target, should be harmonized with the environmental protection and sustainable development. In particular, the notion should be properly embodied in basic values of finance laws such as financial system, financial efficiency and justice.
