通过物权变动理论和例举,阐述了在经济流转过程中动产、不动产、担保物权在设立、变化、消灭过程中的基本要件和外部表现形式,以及外部的公示、公信原则所表现认识的物权状态与真实物权状态不相一致时的解决方法,并说明了在经济交往的商品流通中应使物权变动符合法定形式要件。
The paper firstly elaborates the basic elements and their forms when establishing, varying, diminishing, and clearing movable and immovable properties, guarantee right in rem, and then presents the solutions when the right in rem from the public announcement is not in accordance with the actual state of right in rem. The paper maintains that the change of right in rem should be in keeping with the legal prescriptive elements in the circulation of commodities.
