摘要
本次《物权法(草案)》提出了物权法定原则、公示原则、遵守法律原则、保护物权原则,其与通说相比,将公示公信原则调整为公示原则、放弃了一物一权原则、增加了遵守法律原则和保护物权原则。文章对这些原则的内容作了解释,分析了规定这些原则的作用和意义。
The“Property Right Law (Draft)”puts forward the following principles:the property right legal principle,the princi- pie of public announcement,the principle of law observation,and the principle of property right protection.The previous princi- ple of public announcement and public credit is replaced by the principle of public announcement,the principle of one piece of property endowed with a single right was abandoned,and the principles of law observation and of property right protection are added.This paper explains the content of the above principles and and analyses the functions and significance of formulation of these principles.
