摘要
现行中国不动产登记采登记要件主义,且将登记作为部分债权合同的生效要件,加之登记机关的分散和登记信息资料的保密使不动产登记效力的价值目标无法实现。笔者主张区分物权变动的原因,对因市场交易引起的物权变动,采登记对抗主义辅之善意取得制度;对因非市场交易引起的物权变动则纳入适用除外,并建议统一登记机关和建立信息公开制度。

Distinguish the reason of the real right change , to the real right change caused by marketing, is it register oppose doctrine complement make system with good intention , is it applicable to range except to include to caused by juristic fact beyond marketing real right change in to adopt, propose unifying the registering organ and setting up information to disclose the system at the same time .
