摘要
侦查程序是我国刑事诉讼程序中一个独立的、重要的诉讼阶段,是刑事诉讼整修大厦的基石,如果没有科学合理的建构,之后的诉讼程序将很难公正的进行。由于其活动涉及公民的人身权利、民主权利、财产权利等最基本的人权,因此使侦查程序纳入司法审查和诉讼的轨道,在惩罚犯罪和保障人权之间找到一个合理的平衡点就显得至关重要。而法国的预审制度则为我们提供了很好的借鉴。
Investigatory procedure is an important and independent stage in our criminal lawsuit procedure,More- ovdr,it is the basis of the criminal lawsuit mansion.Without the scientific and proper construction,it will be dif- ficult to carry on justly the following litigation.Because investigatory procedure relates to civil rights,democratic rights,property rights,etc.which are the fundamental human rights,it appears important to bring it into judicial investigation and litigation.Thus sins and guaranteeing human rights can stand on a reasonable basis.In this the- sis,the French inquisitional system is introduced,for it proviides us a good example.
