摘要
宪法是国家的根本法,具有至高无上的地位。一切违宪的行为都应受到宪法的制裁。违宪审查制度就是保证宪法得以实施,裁定并处罚违宪行为的一项根本的宪法制度。当今,违宪审查模式主要有司法机关审查、专门机关审查、立法机关审查三种。为了维护宪法的最高权威,我国应实行以宪法委员会为主的违宪审查体制。
Constitution is the national fundamental law, with supreme status. All unconstitutional acts should be punished according to the constitution. The system of examination of violation of the constitution is a fundamental constitutional system which can guarantee the implementation of constitution, judge and punish unconstitutional acts. Nowadays, there are three patterns in examination of violation of constitution: of the judicial authority, of special organ, and of legislature. To maintain the supreme authority of constitution, a system of examination of violation with the core of constitutional committee should be put into practice in China.
