摘要
从提单的诞生看,提单上附有的权利仅是一种占有权;在转让过程中,提单上也没有附加所有权。在国际贸易和融资等环节也并不要求提单成为所有权凭证。货物的所有权是一种权利状态,游离于提单的文义之外。提单本身仅是一种占有权凭证。
When a B/L signed and issued, the only right attached thereto is the right of possession, and no other right, such as the ownership, is created thereon when it is transferred. A B/L is not required to he a document of ownership during international trade and financing transactions. The ownership in goods is a kind of static right which is free from the descriptions thereon. A physical B/L itself is no more than a document of possession.
