摘要
本文重点讨论船舶优先权与其所担保的海事请求的被请求人的关系。在阐述英国、美国、加拿大和法国的法律与实践以及有关的国际公约的规定的基础上 ,进一步讨论了中国《海商法》的有关规定。得出的结论是 :根据中国《海商法》的规定 ,只有那些针对当事船的船舶所有人、光船承租人和船舶经营人的海事求才受以当事船为客体的船舶优先权的担保。
This paper highlights the relationship between maritime liens and the persons against whom the maritime claims secured by maritime liens are made. With reference to the law and practice of some other countries, such as UK, USA, Canada and France, as well as the relevant international conventions, further discussion is focused on the relevant provisions contained in the Maritime Code of the PRC. It is concluded that under the Maritime Code of the PRC, only those maritime claims against the owners, the demise charterers and the operators of the vessel in respect of which the maritime claims arise may be secured by the maritime liens attaching to the vessel.
