摘要
作者在宁波天一阁发现的原以为失传的宋《天圣令》中保存了大量已佚唐《开元二十五年令》原文 ,附录的唐《田令》更相当完整地保持了原貌 ,弥足珍贵。本文移录了附录的唐田令 48条令文 ,并对经宋改动行用的 7条唐田令进行了复原。在此基础上 ,将其与《唐令拾遗》等书相对照 ,做了考释。此外还探讨了《田令》令文是否完整及令与其它法律规范———律、格、式的关系 ,并由此提出唐令应是唐代法律体系的主干。
The Laws of the Tiansheng reign period of the Song dynasty, the text of which was thought to have been lost but was found by the author in the Tian Yi Pavilion in Ningbo, include a large number of the original texts from the Laws of the 25 th Year of the Kaiyuan Reign Period. The Laws on the Land, the full text of which was appended to the Laws of the Tiansheng Reign Period , is especially valuable. This essay contains a transcription of the 49 articles in full, and the author has restored the original texts of seven articles that were modified in their adaptation in the Song code. Using this as a basis, the author compares the Tang Laws on the Land with Making Good the Omissions in the Tang Codes and other works, and conducts textual research on and provides explanations of the texts. He also examines whether or not the texts are complete as they now stand, and their relationship to lü, ge and shi - the three other categories of legal code. The author concludes by pointing out that of the four categories of legal codes constituting the legal system of the Tang, ling should be the backbone.
