摘要
司法实践中侵害名誉权是一个热点和难点问题,它同肖像权、荣誉权是区别很大的不同概念。结合具体的案例,从法理角度来讲,侵害名誉权的四个构成要件为:行为人有违法行为、有侵害名誉权的损害事实、违法行为与损害后果之间有因果关系、行为人主观上有过错。
The case of infringement upon honorary right is a hotspot and difficult problem in judicial affairs.With a actual case,this paper gives four essential components of the liability of infringement upon honorary right from the point of view of legal reasoning,which are person capable of disposing has illegal acts,the fact of infringement upon honorary right exist,there is causality between illegal acts and damages,person capable of disposing has subjective faults.
