摘要
针对我国煤炭资源管理存在的问题。提出了立法建议 :健全勘查开发规划制度 ;提高探矿权和采矿权的行政审批等级 ;提高煤炭行业的市场准入门槛 ;健全奖惩机制 ,推动技术革新和进步 ;通过立法使矿业权设置和转让合理化 ;在立法时明确规定煤炭资源的有偿使用原则 ;对煤炭资源税费制度进行改革 ;
The paper makes such suggestions on lawmaking as, to perfect the prospecting, developing and planning system; to increase the administrative examining and approval level of prospecting and mining rights; to facilitate market accession of coal industry; to perfect awarding, motivation system and punishment measures; to rationalize mining rights' setting and transferring through legal measures; to stipulate clearly in law the principles on the paid utilization of coal resources; to reform and perfect the taxation system .
