摘要
资产证券化市场正日益国际化。站在某一个国家的角度,含有某些外国因素的资产证券化被称之为涉外资产证券化。中国的资产证券化要想融入国际市场,必须建立起完善的资产证券化法律机制,高度重视涉外资产证券化的法律适用,并根据证券化交易的特殊性实施特殊的外汇和外债管理政策。同时,政府的支持和涉外证券化基础资产的挑选也是重要的。
Securitization market is increasingly on an international scale. Speaking from the angle of country, securitization involving some foreign factors is called foreign-related securitization. If we intend to bring our securitization into the international market, we must establish a perfect legal mechanism of securtization, pay special attention to the adaptation of the foreign-related securitization law, and implement a special policy concerning foreign exchange management and foreign debt management according to the specialty of securitization transaction. Meanwhile, it is also important for us to obtain the government's support and select the basic foreign-related assets.
