摘要
本文就我国旅游合同研究中的概念内涵、法律性质、当事人的权利义务、旅行社旅游服务给付的履行辅助人的责任、纠纷类型、精神损害赔偿和旅游合同立法等进行回顾 ,并着重关注旅游合同研究中的热点问题———新版旅游合同范本。在此基础上对我国旅游合同研究做出评价 ,指出其存在的问题 。
This paper did an overall review on tourism contract studies in China by focusing on several aspects, including the concept and connotation of tourism contracts and its legal natures, rights and obligations of the parties, especially those who assist travel agencies in carrying out tourism contracts, entanglements, compensation for spiritual harm on trip, and legislation of the contract. It also made an analysis of the 2004 edition of tourism contracts, a hot point in researches of this area. The paper evaluated studies on tourism contracts, pointed out the existing problems and put forward some views about its developmental trends.
