摘要
从理论上对检察权制度与法律监督制度加以澄清、厘定。从检察法律监督制度的现状着手,指出了它形成的原因,并分析了检察法律监督制度的缺陷,提出了检察权与法律监督权分离的思路构想。
This paper makes a theoretical verification and clarification of procuratorial and supervisory power. With a case study of our country’s present procuratorial-supervisory system, it points out some holdbacks and raises a framework of the separation of these two powers.
