摘要
19世纪下半期国际法的输入 ,在中国知识界引起了广泛而持久的反响。晚清知识分子以开放的心态肯定了国际法的现实意义 ,以传统文化中的天道思想阐释西方国际法所浸透的自然法观念 ,强调和尊崇国际法的理性精神 ;并在国际法的启发下 ,产生了最初的国家利权观念与主权意识。但在 19世纪特殊的国际环境下 ,残酷的民族生存现实使知识界长期为国际法是否可恃所困扰 ,其国际法观念始终处于矛盾状态 。
The introduction of international law into China had a broad and lasting impact in Chinese intellectual circles in the second half of the 19th century. Approaching this question with open minds, late Qing intellectuals affirmed the practical significance of international law. Employing the Chinese cultural tradition's concept of cosmic order, they expounded the idea of natural law which permeates Western international law, and extolled international law's rational spirit. Taking their inspiration from international law, they gave rise to the earliest consciousness of state and sovereignty. Nevertheless, in the unique international situation of the 19th century, the harsh realities of national survival gave the intellectuals lasting concern as to whether or not international law could be depended on. Their view of international law was always conflicted, preventing them from forming a final positive assessment of international law.
