摘要
知识产权制度在赋予权利人专有的知识产权的同时,也对该权利给予相应的限制,这种限制一般只限于财产权,并且具有有限性和法定特征。对知识产权予以限制,体现了知识产品权益分配的公平正义观,体现了知识产品的社会属性,体现了知识产权人的社会责任,协调与平衡了知识产权人的专有权利与公众对知识和信息的利用需求。
Intellectual property is given some limitations while intellectual property system confers some exclusive rights to the owner thereof. Such limitation is generally limited to property right and pose the nature of limitation and legality. The limitation on the intellectual property embodies the opinion of justice as to the distribution of rights and interests of intellectual products, social nature of intellectual products, the one of public interests of intellectual products and social duties of the owner of intellectual property,and coordinates and balances the exclusive rights of intellectual property and the requirement of social public as to the exploitation of knowledge and information
