摘要
本文从制度再生产的角度 ,探讨了政府单独建构市场规范的局限性问题 ,并试图阐述这样一个命题 :在我国市场规范的建构过程中 ,重要的不只是设定一些适用的成文条法 ,而是实现立法模式的现代转换 ;并且附带说明WTO框架在催引我国实现这种转换中所应该和可能发挥的作用。
Starting from system reproduction, this paper has discussed the limitations for the government to solely construct the market regulations, and has tried to narrate this subject: in the process of constructing the market regulations in our country, what is important is not only to suppose some suitable written regulations but also to realize modern transformation of legitimate mode; there is an additional explanation about the responsible and possible function in realizing this transformation caused in the frame of WTO.
