摘要
劳动教养制度在中国已经存在半个世纪,从上个世纪80年代开始成为学者十分关注的一个话题。本文从制度存在的现实性和理论基础来分析该制度存在的必要性,并对其性质做出合理的定义,在此基础上提出解决问题的出路。总之,必须把劳动教养制度纳入司法控制和司法审查的轨道,赋予其存在的法律基础。
The punishment through labor system has been in China for about a half century, which is considered as a very important topic concemed by scholars. We analyze its necessity of function in terms of reality and theory. And in the basic of the reasonable definition of it we put forward some measures to solve the problems. In all, it is essential to regulate the punishment through labor system in the control and examination of the courts.
