摘要
现代股份公司带来了企业财产权的新变化,它创造了一种企业法人财产制度,并使经营权趋于独立化和强化。这种经营权的分离化,是当代市场经济条件下所有权内在结构的一种调整和演化,而不是对所有者财产权的削弱,认为在股份公司制度下,所有权消失了的命题是不正确的。
Modern corporation with share system brings about a new change of enterprise propri-
etorship, and it finds an enterprise proprietorship of legal person and the right of management
becomes more independent and strengthened. The independence of management right is an
adjustment and evolution of inner structure of proprietorship. It is not the weakening of
owner's proprietorship. It is incorrect to consider that the owner waives completely his right
of disposing his assets.
