摘要
刑事诉讼纵向构造关注的是特定诉讼阶段上控、辩、审三方的法律地位和相互关系 ,其中包括审判与其他诉讼阶段的关系、诉审关系、侦审关系、侦诉关系等等。我国应根据不同构造方式所体现的价值特点和我国的具体需要改善我国刑事诉讼的纵向构造。
The longitudinal structure of criminal procedure concerns the legal status and the mutual relationship between the prosecution, the defence and the judiciary in specific procedural phrases. After studying on the longitudinal structure of Chinese criminal procedure, the author suggests that efforts be made to improve the structure according to the specific situation of China and the characteristics of our values embodied in different structures.
