摘要
地方债券是地方政府发行的按期还本付息的债务凭证。在发达国家,发行地方债券是发展地方经济和地方公益事业最重要的手段之一。我国债券市场中缺少地方债券这一品种,但地方政府的投资冲动导致变相融资和发行债券,由于缺乏明确的法律依据,只能按照企业债券的方式进行运作,短期行为十分明显。我国应当明确地方债券的法律地位,规范其发行、交易及偿还机制,促进其健康发展。
The municipal bonds are the debt certificates issued by local governments. In developed countries, issuing municipal bonds is one of the most important methods by which local governments develop local economy and local public welfare. There are no municipal bonds in the system of bonds in China, but some enterprise bonds have the same nature of municipal bonds. They only take their own ways as enterprise bonds do, without the legal basis of municipal bonds, and have not acquired ideal results. China should establish the legal system of municipal bonds so that it can go into its good developing track.
