WTO《多哈宣言》“第6条款问题”之研析 被引量：6

摘要 2 0 0 3年 8月 30日WTO通过的《关于实施多哈宣言第 6条款的理事会决议》赋予了发展中国家为维护公共健康安全而进口廉价仿制药品的权利 ,从而暂时解决了《多哈宣言》“第 6条款问题”。《总理事会决议》在合格药品范围、合格进口方资格、国内市场的解释等方面采纳了发展中国家的建议 ,这是发展中国家在WTO体制中的一次重大胜利 ,但是《总理事会决议》采用义务豁免模式决定了其法律地位的暂时性。《总理事会决议》对包括中国在内的发展中国家的启示是要善于合理利用TRIPS协定、《多哈宣言》和《总理事会决议》中赋予发展中国家平衡知识产权保护和社会公共利益的灵活条款。
