摘要
国有企业经营权是一个涵义极广而又非常模糊的概念,也一直是学术界所关注的话题。对于其概念和法律性质,学界是众说纷纭,莫衷一是。文章认为,国有企业经营权是国有企业由全民所有制向现代企业制度转变的一个过渡时期的产物,随着我国现代企业制度的建立,经营权将恢复其本来所具有的经济学概念,而将被公司法人的股权所取代。
Managerial authority of state-owned enterprise is a concept of extensive and indistinct meaning,wihch the scholars have been focusing on.Its concept and legal nature vary and don't come to an agreement. The author thinks managerial authority of state-owned enterprise is a result that state-owned enterprise develops from its ownership by the whole people to modern enterprise system.With modern enterprise system set up in our country, managerial authority will resume its economic meaning, and stock right of company will substitute it.
