摘要
法律的存在离不开信仰的支持。西方法律的信仰基础成功地完成了从基督教到理性主义的转型 ,当代中国法律的信仰基础应该是建立在理性主义之上的公平与正义等信念 ,经过扬弃的儒家信仰可以作为合理的思想资源 ,被纳入当代中国的法治文化。
The law can not do without belief. The belief of the Western law has finished the transformation from Christianity to rationalism, but in contemporary China, it should be these faiths, such as impartiality, justice etc., based on rationalism. The Confucian belief, which has developed the useful and discarded the useless, would be incorporated into the culture of Rule of Law in modern China as the reasonable thought resource.
