摘要
伍廷芳精通中外法律,是近代著名法制改革家。在清末担任修订法律大臣时,主持并参与修订法律工作,把近代西方法律思想与实践引入修律的整个活动中,对中国传统法律体系进行了全面删改与创新,进而改变了中国传统法制的固有面貌,在一定意义上宣告了传统法制体系的历史性终结,推动中华法系走出中世纪,迈向近代化。
Very well accomplished in both Chinese and foreign laws, Wu Tingfang was a famous legal-system reformer of the latter-day period. As minister in charge of the emendation of laws during the late Qing Dynasty, he presided over, and participated in, the revision of Chinese laws, introducing into it the occidental juristic thoughts and practices. As a result, he has completely reformed and innovated traditional Chinese jurisprudence, and remodeled traditional Chinese legal system. In this sense, he has brought traditional Chinese legal system to a historical end, and has led it out of the middle ages and made it embark on the road towards modernization to certain extents.
