摘要
由于婚姻法学界对婚姻家庭制度的深层问题重视不够 ,民法学者在探讨民法典的相关问题时 ,对作为其组成部分的婚姻家庭编或简单带过或不予注意 ,这势必影响该编的规范设计。而婚姻立法的价值取向问题决定着该编的风貌 ,需要加以关注 ,同时 ,我国民法典婚姻家庭编应以个体利益与社会利益的均衡为其价值取向。
Because the scholars in marriage law circles have not paid adequate attention to the profound problems of the institutions concerning marriage and family life, the scholars studying the civil laws just casually tackle or simply ignore the law about marriage and family life that is indispensable part of the civil laws, which may surely affects the entity of this part. However, in this part, the value orientation of the legislation on marriage and family life is one of the decisive factors and so it is essential to be cared for.
