摘要
本文通过对汉初《二年律令》中有关条文的考察 ,讨论西汉初年对家庭关系的法律调整。西汉政府在黄老无为政治环境中 ,对法家思想和法律手段维护家庭关系仍然十分重视 ,目的是为了维护家庭的稳定 ,保证国家在家庭稳定基础上加强户籍管理 。
Through the discussion of the “Two-year Regulations” in early Han Dynasty, this paper focuses on the adjustment at law of the relation between family members in the early Western Han Dynasty. The author of the present paper argues that the Government of Western Han, though influenced by the political environment of Natural Adjustment, still paid great attention to the Thoughts of Legalists and to the law administration, and their function of maintenance of familial ties. By doing so the Government of the Western Han meant to stablize the families, to strenghthen the management of household registration and to guarantee the tax revenue and the conscription.
