摘要
婚约对当事人不具有法律约束力已是妇孺皆知,但订立婚约作为一种古老的婚姻习俗仍然存在,因解除婚约而引发的财物纠纷时有发生,现行法律的缺失使该问题的解决尺度不一,标准复杂,因此,必须在婚姻法中增加相应条款,明确解决此类纠纷的标准,增强司法的可操作性。
It is known that the engagement to marriage does not have to the party concerned lawful binding force, but the engagement as a kind of old marriage custom still exists. There are always disputes over wealth due to the fact that the incompleteness of the current law makes the standards different and complicated. Therefore, items in the law of marriage should be increased , and standards should be made clear and explicit so as to strengthen the judicial maneverability.
