摘要
新媒体时代下,现场直播节目越来越普遍地采用网络传播的方式进行播送。然而,我国现有《著作权法》相对滞后,尚无规制同步盗播行为的具体规定,涉及同步盗播行为的司法实践存在较大分歧,这导致现场直播节目的制作者和播出者的权益无法得到有效保障。考虑到WCT已明确规定了"向公众传播的权利",我国应扩展广播权的范围,将网络广播与传统广播方式进行统一设权,以符合WCT的规定。此外,从邻接权保护投资的角度出发,为保护广播组织者的经济利益,我国应扩张现有的广播组织权,参考WIPO制订的《广播组织条约草案》,将网络转播行为明确纳入转播权所规制的范围内。
In the new media age, live shows are becoming more widely spread by network. However, 'Copyright Law' lags behind in China, there is no specific provisions regulating synchronous piracy act. And it has a large of differences in judicial practice, which lead the interests of producers and broadcasts can''t be guaranteed effectively. Considering the WCT has clearly stipulated the 'right of communication to the public', China should expand the scope of broadcasting rights to internet radio. In addition, from the perspective of investment relating right protection, in order to protect the economic interests of radio organizer, refer to the WIPO's draft of broadcasting organization treaty, China should expand the scope of right of broadcasting organizations and make the network broadcast behavior into the range of rebroadcast rights.
