摘要
英国在检察制度创设中一直遵循保守、渐进的改良模式,这使当代的检察制度带有很深的传统烙印,形成了与欧洲大陆国家明显不同的特点。这体现在英国检察机关在检警关系方面不具有主导权等几个方面。有关英国当代检察制度是"奇怪的动物"的提法,只是概括了外在特征,而忽视了其内在精神,即英国举世最为典型的经验主义精神。
The creating mode of public prosecution system in England is conservative,evolutional and improving.As a result,the contemporary public prosecution system in England is deeply influenced by traditional prosecution system and quite different from that of other European countries.For example,the Crown Prosecution Service in England hasn't any authority over the police service in crime investigation.The author don't agree with the argument that the modern public prosecution system in England is'a strange animal'.In the author's opinion, the so called'strange'characteristic is just the form of the contemporary public prosecution system,and the inner spirit of experience which is most typical in England shouldn't be ignored either.
