摘要
在现代科学技术的推动下,人们对海域资源的开发利用已经逐渐从平面开发利用向立体层面开发利用过渡,越来越多的地方开始尝试海域空间的多层次开发利用活动,而海域多层次利用中的使用权问题也已成为海域进一步有效利用的限制条件。文章对海域多层次利用过程中的海域使用权的分层确权做了具体界定,将其分为水面层使用权、水体层使用权、海床层使用权、底土层使用权和综合使用权;同时,对海域使用权分层确权的协调原则、协调手段进行了研究,并从确权前、确权中以及确权后三个方面入手建立了海域使用权分层确权的协调机制。
With the impulse of the modern science and technology,the development and utilization of the sea resources has been gradually transited from the development of the plane to the development of three-dimensional level.More and more people try to develop and utilize the sea areas space,but,the problem of sea areas usufruct in sea areas of multilayered use has become the restricted conditions for more effective use of the sea areas.First,the paper makes specific definition for separating usufruct into layers of sea areas,and makes the usufruct of sea areas into the right to use of surface,the right to use of water,the right to use of subsoil,the right to use of seabed,the right to use of synthesizes.Second,it researches the coordination principle and coordination measures for separating usufruct into layers of sea areas.Last,the paper establishes the coordination mechanism for separating usufruct into layers of sea areas from three aspects.
