摘要
随着我国城市化进程的不断加快和城市建设规模的逐步扩大,国有土地上房屋征收现象大量出现。在房屋征收过程中,由于公权力的不规范行使而导致了一些对公民私权利的侵犯现象。本文以国有土地上房屋征收为视角,从根源上分析了公权与私权的关系及两者产生冲突的原因,以寻求解决国有土地上房屋征收过程中公权与私权两者冲突问题的对策,使城市建设能够和谐发展。
With the constant acceleration of urbanization and the expansion of urban construction in our country,house expropriation phenomenon in state-owned land teemed.In the process of house expropriation,citizens' private rights were violated owing to the lack of standardization of public rights.This paper took house expropriation in state-owned land as a view angle,analyzing the conflict and harmony between public rights and private rights from the source,to seek for some countermeasures to figure out the conflicts and make city construction develop harmoniously.
