摘要
"严打"是现阶段我国重要的刑事政策,也是近年来法学界关注的热点。对其肯定与否定的观点都不难找到一些理论依据。事实上,"严打"一方面最大限度地发挥了刑罚的一般预防功能,满足了公众报应心理,但又在一定程度上体现了刑罚万能的重刑主义思想:"严打"虽然是我国现阶段控制犯罪的必要选择,但又具有明显的行政强制和人治色彩。在刑事一体化的视野下,应理性评估"严打"的得失,将"严打"与国家其他刑事政策、刑事实体法与刑事程序法等加以协调,其中,"重重轻轻"或日"惩办与宽大相结合"应是我国现阶段刑事政策的基点。
The 'strike-hard campaign' is not only an important criminal policy in present China but a hot issue in the law circles. Theoretical foundations can be easily found for or against it. In fact, 'strike-hard campaign' not only has brought the deterrence theory into full play and satisfied public ideas of revenge but showed the idea of heavy penalty believing in the omnipotence of penalty. Although the 'strike-hard campaign' is necessary for controlling crimes, it bears on obvious administrative coercion and the character of rule by man. In the perspective of criminal integration, we should objectively evaluate the 'strike-hard campaign' , integrate it with other criminal policies, criminal substantive law and procedural law, among which 'the combination of punishment with leniency' should be the basis of our criminal policies.
