摘要
刑事古典学派内部存在着对死刑的两种对立的观点。康德和黑格尔基于刑罚正义性的要求,坚持要保留死刑;费尔巴哈依其自创的心理强制学说和功利论提出了保留死刑的观点;贝卡利亚、边沁从功利论的角度要求废除死刑。当然,贝卡利亚更是从人道主义的立场出发要求废除死刑的。事实上,无论是从刑罚正义,还是从刑罚功利论的角度,均不能理由充足地说明保留死刑或废除死刑的必要性,废除死刑最终还只能以人道主义的情怀来促使其实现。
There are two contrary views of death penalty in criminal classical school. Kant and Hegel, based on criminal justice, had insisted on a view of keeping death penalty. However, Bexcaria and Bentham, based on a theory of utilitarianism, had claimed to abolish death penalty. Feuerbach, based on the theory of compelling psychology and utilitarianism,had put forward keeping death penalty. Of course, Bexcaria had claimed to abolish death penalty, and based more on humanism. In fact, it is whether based on criminal justice or utilitarianism's theory, both haven't enough reasons to testify necessity of keeping or abolishing death penalty. At last, abolishing death penalty, only humanism's sympathy will enhance it to be realized.
