摘要
立法价值,是指立法主体的需要与立法对象之间的相互关系。我国目前社会保障立法的现状与社会保障立法价值及其选择有很大关系。社会保障制度,涵盖了社会的、经济的、法律的、文化的多重意义,社会保障立法价值应定位于秩序、公平与效率,并且成为设计我国社会保障制度的前提。
Legislation value of social security refers to the mutual relation between the need of the legislative body and the object. At present, the current condition of social security legislation in China has a lot of things to do with the legislation value of social security and its selection. Social security system has social, economic legality and cultural significance and is to be based on order, equity and efficiency, which is the prerequisite for designing Chinese social security.
