摘要
中国古代监狱史研究历来作为中国古代法制史研究的一项重要的内容而受到学者的重视,但南朝刘宋时期的监狱状况至今未有学者专门撰文论述。刘宋时期的监狱除了因袭魏晋以来的旧制外,不论在监狱的设置和监狱制度的制定上都有一些新的发展,并对唐代的监狱制度产生过影响,成为了唐代监狱制度的来源之一。因此笔者试图主要依靠《宋书》和《资治通鉴》的相关材料,勾勒出刘宋时期监狱的大致的轮廓,引起学者的注意。
The research on ancient Chinese prisons, as one of the most important researches concerning the ancient Chinese legal system, is highly valued by Chinese scholars. But so far there is not any research on the prisons in Song Dynasty in Southern Dynasties. The prisons in Song Dynasty followed the prison system since Wei Jin Ages. In addition, some new development was gained both in prison distribution and in the prison system, which exerted some influence on the prison system in Tang Dynasty. Therefore, by making use of the historical materials from Song Shu and History As A Mirror , the writer attempts to draw a general outline of the prisons in Song Dynasty in Southern Dynasties so as to arouse scholars' attention.
