摘要
我国的科技证据立法与法治的要求相差甚远。明确科技证据法的概念和特征,是科技证据立法的前提。我国的科技证据立法应当坚持科技证据的运用必须符合人权、伦理要求以及恢复科技证据之证据本色的科学理念,并遵循及时性、协调性以及适度鼓励科技证据运用的原则。
The legislation on scientific and technical evidence in China is pale in comparison to the requirements of rule of law. It is premise of the legislation on the scientific and technical evidence that we explicit ideas and features of the scientific and technical evidence law. We should insist on scientific ideas of human rights, ethics, and evidence of the scientific and technical evidence, abide by principles of promptness, coordination and encouragement, when we legislate on the scientific and technical evidence.
